ATIS Real Weatheralls - Industrial Development - Luton, Enterprise Park

Industrial Securities (Developments) Ltd, advised by ATIS Real Weatheralls, has successfully appealed against a planning condition which restricted night time vehicle movements adjacent to Luton Enterprise Park in Luton.

ATIS Real Weatheralls had previously secured planning permission for the development of the 15,551 sq m (167,396 sq ft) industrial site from Luton Borough Council, but with a condition that restricted night-time movement for vehicles over 7.5 tonnes serving warehouse accommodation, but not large industrial units. On appeal this condition was found to be unreasonable and to fail the test of circular 11/95 on the use of planning conditions.

Jeremy Edge, Director – Consulting at ATIS Real Weatheralls says: “Luton Borough Council failed to respond to correspondence, failed to agree any points of common ground before the hearing and then failed to offer an substantive evidence at the appeal.”

Edge continues: “This is a clear example where the planning system has caused unnecessary delay to the developer and harmed the prospects of employment generation in the town.”
